Terms of Service

1. Acceptance of these terms

TradeClub (“TradeClub”, “we”, “us”, or “our”) provides a trading journal, analytics, AI assistance, and community (“club”) platform through our website and applications (the “Service”). By creating an account or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for all activity under your account.

You are responsible for keeping your password and account credentials secure. Notify us immediately of any unauthorized use of your account.

3. The Service

TradeClub helps you sync and journal trades, review performance, receive AI-assisted insights, and participate in trading clubs. Features available to you depend on your subscription plan.

We may add, change, or remove features, and we may set or change limits on the Service at any time.

4. Not financial advice

TradeClub is a software tool for journaling and analysis. Nothing in the Service — including AI-generated summaries, plans, scores, or coaching — is financial, investment, tax, or legal advice, and nothing constitutes a recommendation to buy or sell any instrument.

Trading carries substantial risk of loss. You are solely responsible for your own trading decisions and outcomes.

5. Subscriptions and billing

Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor. By subscribing, you authorize us to charge the applicable fees to your payment method until you cancel.

You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

We may change pricing for future billing periods; we will give reasonable notice before changes take effect.

6. Clubs and creator payouts

Clubs let creators publish content and offer free or paid membership. Creators are responsible for the content they publish and for complying with applicable laws and tax obligations.

Paid clubs are processed through a third-party payment provider, and a platform fee applies to member revenue based on the creator plan. Payouts are subject to that provider’s terms and verification requirements.

7. Acceptable use

You agree not to misuse the Service. In particular, you will not:

• Break the law or infringe the rights of others;
• Upload malicious code or attempt to disrupt, overload, or gain unauthorized access to the Service;
• Scrape, resell, or reverse engineer the Service except as permitted by law;
• Post content that is unlawful, abusive, deceptive, or violates another person’s privacy or intellectual property.

We may suspend or terminate accounts that violate these terms.

8. Your content

You retain ownership of the trades, journals, images, and other content you submit. You grant TradeClub a limited license to host, process, and display your content as needed to operate and improve the Service.

When you choose to share content publicly or within a club, you are responsible for what you share. Do not share confidential or sensitive information you are not permitted to disclose.

9. Intellectual property

The Service, including its software, design, and trademarks, is owned by TradeClub and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these terms.

10. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be accurate.

To the maximum extent permitted by law, TradeClub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or trading losses, arising from your use of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
